Philadelphia Corporation for Aging (“PCA”) is offering its consumers access to the Silvernest Program because it recognizes that some of its consumers may have an interest in being either a HOST or a HOMESEEKER. Those terms are defined in the Silvernest Program documents and its Terms of Use. Other than offering the Silvernest program link through its website, and providing informational materials prepared by Silvernest, PCA’s roles and responsibility for the program are limited to providing information about and access to the Silvernest program to PCA consumers.
As a HOST or HOMESEEKER you will have certain responsibilities and obligations. They are described in the Silvernest materials. PCA will not have any role in or obligation to either the HOST or the HOMESEEKER in inspecting or certifying the suitability of the premises, its compliance with local landlord-tenant, housing and/or zoning laws. These are the responsibilities of the HOST and the HOMESEEKER.
If you use the Silvernest Program, either as a HOST or a HOMESEEKER, you are solely responsible for the rental agreement that you enter into with the other party. Silvernest may provide samples, but neither PCA nor Silvernest provide legal advice to the HOST or HOMESEEKER and you are responsible for these legal agreements. HOST should work with their personal legal advisor to review and negotiate a lease that complies with the applicable local and state laws.
The Silvernest Terms of Use (available online after you accept these PCA terms), includes binding arbitration provisions, class action waivers and other waivers of rights that you should be careful to review and understand if you use this program. Those terms include waivers, disclaimers and other legal provisions that you should consider before entering into the program. If you use the Silvernest services, you are automatically agreeing to those terms.
The Silvernest Terms of Use also provide that by agreeing to the Terms, you consent to Silvernest’s sharing of your personal information with Silvernest affiliate organizations and trade partners unless you exercise your right to opt-out of giving your consent to this sharing. The Terms describe the process that you will need to follow if you want to opt-out of this consent
You agree that you are assuming the risk of using the Silvernest program and any risk from participating in the Silvernest program and any contact you have with other Silvernest program participants remains with you. You agree that PCA will not be responsible for any damages, including damages for personal or bodily injury or emotional distress arising from your involvement in the Silvernest program, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory. You agree to release and hold PCA harmless from any claim for losses, damages and any other harm, including any special or consequential damages, whether to your property or to your person, that may arise out of your participation in the Silvernest Program.
Any disputes that you may have with PCA about the Silvernest program will be subject to the identical informal efforts to resolve disputes, the waiver of jury trial and class action suits, and the arbitration provisions as outlined in the Silvernest program Terms of Use. Those provisions are incorporated by reference and shall apply to any claims against PCA.
You agree to indemnify, defend and hold PCA harmless from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees and costs, arising from your use of the Silvernest program.
You agree that any notices or other communications that PCA needs to send may be sent electronically to the email address you have on file with PCA.
